On November 7, the Wisconsin Supreme Court will hear oral argument in Horizon Bank, N.A. v. Marshalls Point Retreat, LLC and Allen Musikantow—a case in which WBA submitted an amicus brief. The case addresses whether sec. 865.165, Wis. Stats., or the stipulated judgment signed by the bank, the guarantor, the borrower, and the circuit court, governs the determination of the fair value of the property to be credited against the money judgment against the guarantor. WBA’s brief agreed with the bank’s position and the Wisconsin Court of Appeals decision that the stipulated judgment governs the transaction.
