Session III Topics: Regulation O, Flood Revisions Update, Loan Officer Compensation

The third quarter 2021 Community Bankers for Compliance program will focus on three different areas of a bank’s lending program.

We will discuss Regulation O. Inside the CBC program, we have not focused on the regulation for a number of years. In recent months, the number of questions regarding Regulation O issues has gone up significantly on our hotline, leading us to believe it is time to review the regulation to ensure that everyone understands the rules. Penalties for violations can be massive. Any number of banks have created difficulties for themselves because what seems logical and reasonable is not legal because of the regulation. We will cover the rule completely, as well as include a number of real-life situations, hotline questions and answers, and other useful information. Discussion of the regulation as well as what people are experiencing in the field will make for a very complete view of this regulation.

On October 1, 2021, there will be changes to the flood insurance program. While they are not monumental and many of them will not affect banks, there are clarifications and useful information that bankers need to know. As every fine for a flood violation is extraordinarily expensive, we want to make sure that all CBC members have the opportunity to understand exactly what the flood rule will now require, so that you can avoid those horrendous fines.

As the economy begins to recover, and the refinance market seems to be drying up, we have been receiving a number of calls regarding what you can and cannot do regarding loan officer compensation. In a previous session, we reviewed the small lenders guide for loan officer compensation, however, we have not discussed the rule itself in several years. As banks attempt to maintain market share and to do so (in part) by increasing compensation or changing compensation packages, this is a very pertinent and timely topic.

The subjects for the regulatory update will be determined by circumstances and releases from the various agencies.

Compliance officers, senior mortgage management, lending management, lenders and processors, and any others with responsibilities for lending should attend. Additionally, audit personnel will find this session useful.

Bill Elliott, CRCM, Senior Consultant and Director of Compliance Education, Young & Associates, Inc.

Bill Elliott has over 40 years of banking experience. As a senior compliance consultant and director of compliance education with Young & Associates, Inc., Bill works on a variety of compliance-related issues, including leading compliance seminars, conducting compliance reviews for all areas of compliance, conducting in-house training, and writing compliance articles and training materials. 

During his career, Bill spent 15 years as a compliance officer and CRA officer in a large community bank and worked for a large regional bank.  He has been a lender for consumer, commercial, and mortgage loans, and has managed a variety of bank departments, including loan review, consumer/commercial loan processing, mortgage loan processing, loan administration, credit administration, collections, and commercial loan workout.

Sharon Bond, CRCM Consultant, Young & Associates, Inc.

Sharon Bond is a consultant in the compliance department at Young & Associates, Inc. where she specializes in consumer compliance. Sharon works on a variety of compliance-related issues, including leading compliance seminars, conducting compliance reviews for all areas of compliance, conducting in-house training, and writing compliance articles and training materials. With over 30 years of industry experience, she has a strong background in mortgage lending and in federal consumer compliance laws and regulations. Sharon was an Associate National Bank Examiner with the Office of the Comptroller of the Currency (OCC) for five years. She holds the designation of Certified Regulatory Compliance Manager (CRCM) and the Six Sigma Qualtec Black Belt certifications.
